Terms & Conditions

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User") and Shivani Ray, proprietor, operating under the brand Spokina (developed and maintained by Logixhunt). By accessing or using any part of Spokina's services — including the mobile application, website, AI features, and subscriptions — you confirm that you have read, understood, and agree to be bound by these Terms.

If you are accessing Spokina on behalf of an organization, you represent that you have authority to bind such organization to these Terms.

As a user of Spokina, you agree to:

• Use the application solely for lawful, personal, and non-commercial educational purposes.
• Provide accurate and complete information during registration and at all times thereafter.
• Maintain the security of your account credentials and not share them with any third party.
• Notify Spokina immediately of any unauthorized access to or use of your account.
• Respect the intellectual property rights of Spokina and third-party content providers.
• Not use automated scripts, bots, or tools to access or interact with the application.
• Not submit harmful, abusive, threatening, obscene, or illegal content through any feature of the App.
• Not attempt to reverse engineer, decompile, disassemble, or modify any part of the application.
• Not circumvent, disable, or interfere with security features, usage limits, or access controls.

Violation of these responsibilities may result in immediate suspension or permanent termination of your account without notice or refund.

To access Spokina's features, you must create an account using a valid mobile phone number. You represent and warrant that:

• You are at least 13 years of age. Users under 18 should use the app with parental supervision.
• You will maintain and promptly update your account information to keep it accurate.
• One account per individual is permitted. Creating multiple accounts to circumvent limits is prohibited.
• You are solely responsible for all activity occurring under your account.

Spokina reserves the right to terminate, suspend, or modify accounts at its sole discretion if these conditions are violated.

All payments made on the Spokina platform are processed through authorized and regulated payment gateways. By making a payment, you authorize the processing of the transaction amount specified at checkout.

• All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Payment details are processed securely. Spokina does not store your card or bank account information.
• You are responsible for ensuring sufficient funds or credit are available at the time of transaction.
• In case of a failed transaction due to payment gateway issues, please contact support before retrying.
• Fraudulent chargebacks or disputed payments may result in permanent account termination.

Spokina offers the following subscription tiers:

• Free Plan: Limited access to core features with daily usage caps.
• Regular Plan: Enhanced access with higher daily limits and additional learning modules.
• Pro Plan: Full unrestricted access to all features, highest usage limits, and priority AI responses.

Subscription details, pricing, and billing frequency are clearly displayed prior to purchase within the application. Subscriptions are billed on a recurring basis as per the plan selected (monthly or annually). You may cancel your subscription at any time through the Subscriptions section in the App; access to premium features continues until the end of the current billing cycle.

Spokina reserves the right to modify subscription features, pricing, or availability with reasonable prior notice.

All purchases made on the Spokina platform are final. Please review our refund policy carefully before completing any purchase.

This policy applies to all subscription plans, one-time purchases, and in-app transactions. By completing a payment, you acknowledge and agree to this no-refund policy. If the same payment was charged twice by mistake, please contact our support team at contactspokina@gmail.com within 48 hours with your transaction details. If the duplicate payment is confirmed, the extra amount will be returned to the original payment method.

Spokina is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Spokina and its proprietor shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the service.
• Loss of data, profits, revenue, or business opportunities resulting from use of the application.
• Inaccuracies in AI-generated content, which is provided for educational purposes only and does not constitute professional advice.
• Service interruptions due to maintenance, technical issues, or circumstances beyond our reasonable control.

Our total aggregate liability, if any, shall not exceed the amount paid by you for the service in the three (3) months preceding the claim.

Spokina reserves the right to suspend, restrict, or permanently terminate your account and access to services at any time, with or without notice, if:

• You breach any provision of these Terms.
• You engage in fraudulent, abusive, or illegal activities on the platform.
• Continued access poses a risk to the security or integrity of the platform or other users.
• You initiate unauthorized chargebacks or payment disputes.

You may also terminate your account at any time by using the account deletion feature within the App settings or by visiting spokina.com/delete-account. Termination does not entitle you to any refund of unused subscription time.

Your use of Spokina is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, store, and protect your personal information.

Spokina does not sell your personal data to third parties. Data shared with third-party service providers (e.g., AI processing, payment gateways, OTP delivery) is governed by their respective privacy policies and is used solely to provide our services.

All content, features, design, branding, code, text, graphics, logos, audio, and materials available through Spokina are the exclusive intellectual property of the proprietor (Shivani Ray / Logixhunt) and are protected under applicable Indian and international intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable, revocable license to use the application for your personal educational purposes.
• You may not copy, reproduce, modify, distribute, create derivative works from, or commercially exploit any part of the application without prior written permission.
• User-generated content submitted through the application (e.g., voice recordings for speech-to-text) remains your property, but you grant Spokina a non-exclusive license to use it solely to provide and improve the service.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or your use of Spokina shall be subject to the exclusive jurisdiction of the competent courts located in Durg, Chhattisgarh, India.

Before initiating any legal proceeding, you agree to first attempt to resolve the dispute informally by contacting Spokina at the address below and allowing 30 days for a good-faith resolution attempt.
